The Department of Labor (DOL) has issued a request for information (RFI) from all interested stakeholders to determine how to proceed with potentially new proposed regulations on overtime.
The DOL announcement follows a number of court challenges that have blocked the implementation of overtime regulations adopted by the Obama Administration in 2016. Those final rules increased the salary threshold for eligibility from $23,660 to $47,476 per year, or from $455 to $913 per week (updated every three years) and raised the threshold for highly compensated employees from $100,000 to $134,004 per year. No changes were made to the “duties” test.
Independent Sector joined with over 146 organizations in submitting comments to DOL to share concerns about the impact on nonprofit organizations and offer suggestions in response to the initial proposal of these regulations in 2015.
The RFI is a strong signal that the Trump Administration is seriously considering significant changes to current Fair Labor Standards Act overtime regulations, including lowering the salary threshold for eligibility. Specifically, DOL seeks comment on 11 distinct questions, outlined in the RFI release in the Federal Register.
